Candor from the legal left

Courtesy of Professor Kim Roosevelt:

"In a sense, yes . . . Of course in academia you're much more engaged in a disinterested search for truth, and I like that." But Roosevelt doesn't think academia is entirely disinterested. "You don't necessarily have a client, but maybe you have your particular political beliefs that are driving you to try to reach a certain conclusion. I try very hard to justify Roe v. Wade. Very difficult to do. But I wouldn't be trying so hard if I weren't ideologically pro-choice. It's still difficult to try and be completely objective."

(h/t Stuart Buck)

Observations by BoBo

1) Isn't the professor's name Kermit and NOT Kim?

2) I think this is true of any academic who is politically active. In order to encourage one's political agenda, one must first make sure that it is legally acceptable to the mass of people. Some conservative academics can be just as results-oriented as liberal academics. In general, it would be nice if everyone could be objective about his own behavior and/or motives, but that seems contrary to human nature. C'est la vie!

PBA ban upheld by BoBo

Does anyone have any more doubts about Kennedy or Alito that they would like to express now?

Great news. It'll be interesting to see whether Alito and Roberts wrote or joined a separate opinion calling for Roe to be overruled. As a tactical matter for when the next vacancy arrives, it would be better if at least one of them did not, so that it is not known with certainty that the next seat will be the fifth vote for overturning Roe.

Kim is his nickname by Alexham

Kim is what he goes by. But you're right that Kermit is his first name.

The only "tactical" fault with Thomas' dissent it that it troubles pro-choice moderates who believe that they can deceive opponents of legalizing abortion to support a proponent of legalizing abortion who dishonestly labels himself as being "pro-life" one more time.

When "settled-law" Roberts failed to join the dissent, the pro-life movement, now, ought to rethink it support of moderate establishment candidates who call themselves "pro-life."

The country was has a continuous leftward drift precisely because both the liberal and conservative movements have leaders that are far to the left of their respective memberships. The country will only turn to the right when rank-and-file conservatives demand truly conservative candidates and leadership.

It is the obligation of parents to see to the good health and proper education of their children. Children cannot do such for themselves. Either their parents will, their family will, the state will, the community will-- "it takes a village"-- or the child will die.

When that obligation shifts from the parents, or family, we cease to be free, independant individuals, and become wards of the state. People who support Roe are not only morally defective, ie unable to properly distinguish between what is right and wrong, and Constitutionally ignorant, since their simply isn't such a "right" in the Constitution, but, in addition, fundamentally autocratic. Roe has reduced children from the legal status of human beings to consumer discretionary purchases that come with a satifaction guarenteed.

It is even being offered that they should come with a thirty day return to maker policy, aka "infanticide," so that the defective models can discarded.

Kennedy is one record as taking the Constitutionally and morally defective position. Alito could have taken the Constitutional and moral position, but he refused.

Those are my doubts.

Again. Some moderates may be happy that conservatives have been tossed enough bones to stay "on board" the moderate establishment train.

The country was has a continuous leftward drift precisely because both the liberal and conservative movements have leaders that are far to the left of their respective memberships. The country will only turn to the right when rank-and-file conservatives reject their current moderate leadership as ineffective and liberal.
