Illinois Confirmation

Illinois Appellate Judge Frederick Kapala was confirmed 91-0 today to be a federal judge in the state’s Northern District.

I think the situation might be looking up, though, in the near future. With the next two weeks slated to discuss the old McCain/Kennedy immigration plan, I anticipate a lot of free time for confirmation votes while immigration negotiations are going on. It probably will take a week to ten days before the Senate begins voting on amendments to an as yet uncrystallized immigration reform bill. Here's hoping for a month in which Livingston, Southwick and the three Michigan district court nominees get confirmed.

I'm not unhappy, its just that we should be seeing several of these per week.

Here's an amusing tidbit to ponder the next time you hear Leahy & Co. piously pontificating about the importance of giving precedence to "judicial emergency" nominees.

District judge nominees Settle and Kapala were both at the same hearing on March 13th, and both were reported out of Committee to the Senate Floor on April 25th. The seat Settle is nominated for is listed as a "judicial emergency". The seat Kapala is nominated for is NOT.

So who was confirmed by the full Senate today? That's right, Kapala. And who is still languishing on the Executive Calendar (for a few more days at least) while that pesky judicial emergency in the State of Washington goes on? Settle, of course. Priorities are malleable things to Senate Democrats.

After the vote for S.1082, the Senate will debate on Livingston for three hours and then vote on her. She has truly been quickly fast-tracked.
