Maybe the Constitution has something to do with it

In today’s Washington Post, Edward Lazarus writes that the lesson of the just-ended Supreme Court term “is that a rare triumphant [50-year] chapter in judicial history has come to a definitive close.” Triumphant if you’re a liberal, that is.
Lazarus concludes that progressives “will need a significantly different strategy and focus,” because “the progressive approach to looking to the judiciary for social and political salvation has always run against the grain of history.” And against the grain of the Constitution, he forgot to say. Seemingly unaware of the Founding Fathers’ intentions, Lazarus is left to speculate that the Court’s “conservative normalcy” may be due to “the demographics of the justices or the often retrospective nature of judicial review.”
Lazarus believes that “progressives will now have to win their battles in the political arena.” Let’s hope he got that one right.
Kennedy likes Roberts?

"Kennedy, 70, said in an interview Friday that he was pleased to see Roberts become chief justice."
I hope Kennedy maintains that belief and continues to help Roberts and Alito rectify the state of law in United States.

Ted Olson on Fox News last night (Sat. night)? I thought he provided very fine analysis re the SCOTUS term just ended. The part I saw had no politics (Rudy free!). I took notes and hope to share them with you later today, unless someone links to the transcript before then! (Is that a worse threat to youse guys, than Reid threatening the senators that they might have to miss their beloved August break?)

What else could Kennedy say? That he doesn't like Roberts and wishes Sandy O' was back? Not even the most liberal justices would allow themselves such an inappropriate public comment. Although Ginsburg has come pretty close to saying that (but only in the context of her being the only woman now on the court now)

I have long disagreed with most of Lazarus's posts on Findlaw, but he (and many other liberals) now seem to get the notion that changes in our political system need to come primarily from the legislative and executive branches and not the judicial branch. Now, if we can just keep the Iraq War from giving the Dems the White House in 2008.
